TERMS OF THE AGREEMENT: Nothing in this Agreement is intended to create a contract for a definite term. Boat owner/Customer and Brite Boat Services LLC may cancel at any time for any reason.
TERMS OF SERVICE: The Customer/boat owner (Customer) agrees to these terms of service. Brite Boat Services LLC reserves the right to modify or alter the terms at any time. Services are provided at Customer request. Subject boats vary greatly due to age, style, regular maintenance, size and location. The charge for service is an agreed amount, not necessarily based on a specific outcome. The Customer agrees to pay the total amount due prior to start of service. The Customer is required to provide access to the boat, running water with a hose bib connection and electricity.
QUALITY OF SERVICE: The quote, estimate, or invoice will indicate services provided. If the Customer is not satisfied, contact Brite Boat Services LLC within 24 hours to correct issues. Refunds are not offered.
PREPARING FOR YOUR DETAILING: The Customer can assist with service by removing/stowing personal items and securing valuables. In addition, any items that may hinder services. Lock areas where service is not wanted. The Customer is responsible for any need to move the boat, and for securing the boat.
KEYS AND SECURITY ALARMS: The Customer is to allow access to the boat at the prearranged time for service. Delays in boat access may be subject to rescheduling or a delay fee of $50.00. The security system should be in the OFF position. It is the Customers responsibility to reset security system and lock boat after completion of service. Brite Boat Services LLC is not responsible for securing the boat to the dock or dock lines.
ACCIDENTS/DAMAGE: The Customer agrees to defend, hold harmless and indemnify Brite Boat Services LLC and its staff, including independent contractors and subcontractors, from all damages or injury associated with providing services to the Customer and release them from liability and responsibility for any accident, damage or injury. All boat surfaces are assumed sealed and ready to detail without causing harm. If you have other items you prefer we not clean or handle, please call or email the office and we will arrange to avoid those items. Because of the nature of providing services to your boat, there will be physical actions of stepping, kneeling, crawling, leaning, sitting, standing, and climbing on all areas of the boat. Safety is a priority. If some damage does occur during the providing of services, the Customer will be notified. The Customer agrees that Brite Boat Services LLC is not responsible for aging of the boat and not responsible for existing deterioration such as cracks, broken or bent parts, corrosion, water damage or loose fittings, and other such wear and tear.
JOB START/END TIMES: Work begins from the time of arrival to boat location to the loading back up of supplies just prior to departure.
SCHEDULING & CANCELATION POLICY: It is the Customer’s responsibility to arrange the time of service with Brite Boat Services LLC. A 48 hour courtesy notice of cancellation is expected by either party and efforts to reschedule will be made. If service cannot be conducted due to other circumstances, no notice of cancellation is provided prior to arriving at the site, and access is not permitted for any reason, a cancellation fee of $50.00 will be charged.
EXTRA REQUESTS: The Customer agrees that extra requests after the initial quote will be an added charge and included in the final invoice for payment.
EQUIPMENT AND SUPPLIES: All supplies are included with the service. Brite Boat Services LLC follows Clean Green Boating concepts, using environmentally preferable products and following California Dept. of Boating & Waterways guidelines (https://dbw.parks.ca.gov/?page_id=29184).
PAYMENT POLICY: Payment is due in full prior to start of service. Please do not leave any payments on the boat. Electronic Debit or Credit Card payments are preferred. Checks and cash are also accepted. Make checks payable to: Brite Boat Services LLC. Mail checks to: Brite Boat Services, 1320 Ynez Place Unit 181828, Coronado, CA 92118. A fee of $30.00 will be charged for each “not sufficient funds” (NSF) check returned by the bank. In the event an account requires legal or collection action, Customer agrees to pay all cost of collection without limitations for reasonable attorney fees, interest on past due amount, court costs, and all collection costs. Brite Boat Services LLC reserves the right to place a lien and or a judgment upon the boat for a delinquent payment and the Customer agrees to pay all legal fees and time spent for remedy.
LATE FEE: Overdue payments are subject to a late fee of $25.00 for accounts overdue by 30 days. In addition, interest will be charged at the rate of twelve percent (12%) per annum on all overdue amounts accruing monthly.
